1. Introduction and Scope of Application
The services are provided by Mouamah Ltd. from its headquarters in Algiers, Algeria. These terms apply to the website, the Mouamah platform, the digital agents, the demo, subscriptions, custom agent requests, and any digital service that refers to these terms. Where Mouamah has concluded a separate contract or a service level agreement with a customer, the provisions of that contract shall apply to the extent of any conflict with these terms, provided they do not contravene mandatory regulations.
2. Nature of Mouamah's Services
Mouamah provides enterprise artificial intelligence solutions, including professional AI agents, operations and monitoring tools, analytics and organizational knowledge capabilities, integrations depending on the plan or project, and the ability to build custom agents. Some features may be experimental, available only to specific categories of users, or require technical setup before activation.
3. Demo and Free Trial
The free trial is intended for exploring samples of the Mouamah experience and the agents' capabilities, and may be limited in functionality, capacity, duration of use or integrations. The free trial does not constitute a commitment to provide all the features of the paid plans, and its scope may be modified or the trial discontinued, subject to legally acquired rights.
4. Eligibility and Authority
If you use the services on behalf of an organization, you represent that you have the authority required to act in its name. You are responsible for the accuracy of your account and contact information, for protecting your login credentials, and for any activity carried out through your account or permissions, unless the activity results from a malfunction for which Mouamah is legally responsible.
5. Acceptable Use
Mouamah's services must be used for lawful and professional purposes. It is prohibited to use the services to breach systems, distribute malware, circumvent security controls, infringe the rights of others, process data that you are not authorized to use, create unlawful content, or attempt to extract system secrets or access keys or to disrupt the service. Mouamah may restrict or suspend use where there is a security risk or a material breach, subject to the requirements of the law and the contract.
6. AI Outputs and Human Responsibility
Agent outputs are intended to support work, analysis and decision-making and are not an automatic substitute for professional judgment or human review where the task requires it. AI models may produce incomplete or inaccurate outputs; outputs must therefore be verified before being relied upon for legal, financial, regulatory, health or safety decisions or any other high-impact decision. The customer remains responsible for determining the appropriate level of review and approval within its organization.
7. Customer Data and Content
The customer retains its rights in the data, files and content it submits to the service. The customer grants Mouamah and the processing providers it engages the authorization necessary to process such content to the extent required to provide, operate and secure the service and improve its performance, in accordance with the Privacy Policy and the applicable contract. The customer may not upload data or files that it does not have the right to use or process.
8. Intellectual Property
Mouamah's rights in its platform, software, interfaces, design, trademarks, documentation, technical components and proprietary models remain reserved. A subscription grants a limited, non-exclusive and non-transferable right to use the service for the duration of the subscription and does not transfer ownership of the technology, the trademark or the core components to the customer. Third-party rights remain subject to their own licenses.
9. Third-Party Services and Integrations
Some features may rely on services, interfaces or models provided by third parties. These services, their terms or their availability may change beyond Mouamah's control. We will endeavor to manage integrations reasonably, but the use of a third-party service may also be subject to the terms and policies of its provider where applicable.
10. Subscriptions and Fees
Paid plans, prices, billing cycles, renewal, cancellation and refunds are governed by our Pricing page and the Subscription, Cancellation and Refund Policy. If a commercial offer or a written enterprise contract differs from the public price on the website, the price and terms set out in the approved offer or contract shall prevail for that customer.
11. Availability and Updates
We work to maintain the availability and stability of the services, but maintenance, updates, outages or limitations related to infrastructure, model or network providers may occur. Features and interfaces may be updated to improve the service, security or compliance, while avoiding the removal of material contractual rights without appropriate arrangements.
12. Suspension and Termination of Use
The user may stop using the service or cancel renewal in accordance with the Subscription Policy. Mouamah may suspend or terminate access in the event of non-payment, serious breach, unlawful use, a security threat, or where suspension is required by law. When the relationship ends, customer data will be processed and deleted or returned in accordance with the contract, the Privacy Policy and legal requirements.
13. Limitation of Warranty and Liability
The services are provided in accordance with the announced or agreed specifications and commitments. To the extent permitted by law, Mouamah does not warrant that every AI output will be error-free or suitable for every particular purpose without review. These terms do not exclude any right or liability that cannot be excluded under the laws and regulations in force in Algeria, including mandatory consumer rights where applicable.
14. Changes to the Terms
We may update these terms when the service or legal requirements change. The date of the last update will appear at the top of the page, and where there is a material change we will display an appropriate notice depending on the nature of the change and the relationship with the user.
15. Governing Law and Jurisdiction
These terms are governed by the laws and regulations in force in Algeria. Disputes shall first be settled through communication and an attempt at amicable resolution, and shall then be referred to the competent authority or court in Algeria, unless the law or the contract requires a different course.
